EveryScape hits Adobe with patent infringement lawsuit

Newton firm EveryScape Inc. is going after Adobe Systems Inc. in court, asserting the San Jose, Calif.-based software company copied a plug-in that EveryScape founder Byong Mok Oh had developed for use with Adobe’s popular Photoshop image editing software and began passing the technology off as its own.

Oh founded EveryScape in 2002 with a plan to provide high-definition images of streetscapes and business interiors, to couple with business directories. Google Inc. beat him to the streets with its Street View product, and since then EveryScape has focused on plush 3D tours of business interiors. EveryScape just moved into its new Newton headquarters with 50 employees and plans to double its headcount.

In a lawsuit filed in U.S. District Court in Boston on Monday, EveryScape and Oh allege that Adobe infringed two patents the company holds – one issued in 2008, the other in 2009 – both protecting a graphics editing technology dubbed “structure preserving clone brush.”

Oh developed the technology in question while a doctoral candidate at MIT and began marketing it in 2005 through another company he founded, Mok3 Inc., as a plug-in to Adobe’s Photoshop software. He alleged in Monday’s complaint that soon after, the California graphics software giant introduced a new feature, Vanishing Point, that it packaged with new versions of the Photoshop software. Oh complained in the lawsuit that Vanishing Point copied his plug-in technology and cut into the plug-in’s sales.

Oh declined to comment. Adobe’s press office could not be reached in time for this article.
