Court rules against Hologic patent infringement claim

Hologic Inc., a Bedford-based women’s medical diagnostics, imaging and surgical products firm, lost a patent infringement suit the company brought against SenoRx Inc. in the U.S. District Court for the Northern District of California.
The law suit was filed by Hologic, its Marlborough subsidiary Cytyc Corp. and Hologic LP Inc., alleging two claims of patent infringement on its brachytherapy technology, a form of radiation treatment where radioactive “seeds” are placed in cancerous tissue. The jury found neither claim to be valid.
Hologic officials said they plan to appeal the decision, noting, “We believe the decision was based in part on an incorrect claim construction,” according to Mark Casey, Hologic senior vice president and general counsel.
Hologic (Nasdaq: HOLX) first filed the lawsuit against its California-based competitor in January of 2008.
